TERMS AND CONDITIONS OF DELIVERY

UNLOADING

Purchaser is responsible for providing suitable access to point of delivery and providing acceptable wash down area compliant with TCEQ. No cancellations are accepted after concrete has been batched.

Drivers are prohibited from delivering concrete except under the truck’s own power, and where site conditions permit the safe and proper operation of the equipment. Drivers are not permitted to add water to the mix to exceed the maximum slump nor to go beyond the curb line, except upon the authorization of the customer and his acceptance of risk for any loss or damage. You are allotted 1 hour of unloading time. After 1 hour, you will be charged standby time at a rate of $2.00 dollars per minute.

ADDITIONAL WATER ADDED TO THIS CONCRETE WILL REDUCE STRENGTH. ANY WATER ADDED IS AT CUSTOMERS OWN RISK

TAKE THESE PRECAUTIONS:

AVOID ALL CONTACT WITH EYES WEAR RUBBER BOOTS AND GLOVES, AND AVOID PROLONGED CONTACT DIRECTLY WITH SKIN OR THROUGH POROUS MATERIALS IN CASE OF CONTACT WITH SKIN OR EYES, FLUSH THOROUGHLY WITH WATER IF IRRITATION PERSISTS, GET MEDICAL ATTENTION PROMPTLY KEEP CHILDREN AWAY

TERMS: Credit accounts are Net 30 from date of invoice. A late payment Service Charge of 1 ½% per month will be charged on accounts 30 days past due from date of billing. This Service Charge is an Annual Percentage Rate of 18%. Minimum Service Charge $1.00. In the event any account is not fully paid when due, Buyer agrees to pay upon demand all expenses and fees reasonably incurred in collecting the balance due, whether a legal action is filed. Such expenses shall include, but are not limited to, attorney fees and other professional fees incurred in the collection process. If legal action is instituted, Buyer shall be liable for all fees, costs, and expenses awarded by the trial court or by any appellate court.
